Court reporting states that Patel was convicted of four summary sexual offences involving three victims, including an adult woman and a minor. The incidents involved unwanted touching while Patel was at the water park. The Crown had sought a total sentence of 40 months, while the defence argued for a sentence of 18 to 23 months to be served in the community. The judge ultimately imposed 23 months in custody. Patel is reportedly not a Canadian citizen and holds a work permit. His immigration status means the criminal conviction could have serious consequences for his ability to remain in Canada. Under Canada’s Immigration and Refugee Protection Act, a foreign national can be found inadmissible for serious criminality when a Canadian conviction results in a sentence of more than six months. The case may therefore also lead to immigration enforcement and removal proceedings.
